These Terms govern your use of TempoHR, operated by Brightstack, a division of Michell + Marteen LLC. By creating an account, you agree to these Terms.
1.The Service

2.Accounts
Must be 18 or older to use the Service.
You are responsible for account security. Notify legal@brightstack.us immediately of any suspected unauthorized access.
Provide accurate, current, complete information.
3.Acceptable Use
You agree NOT to:
- Use the Service for unlawful purposes.
- Spam or harass other users.
- Impersonate any person.
- Gain unauthorized access.
- Reverse engineer the Service.
- Use automated scraping tools without written consent.
- Upload illegal or infringing content.
- Interfere with Service infrastructure.
Violations may result in immediate termination.
4.Content
You retain ownership of your content. You grant us a limited license to host, display, and transmit it to operate the Service.
You are responsible for legal basis to collect personal information you upload. You may not upload unlawful, harmful, or infringing content.
5.Subscription and Payment
Billed in advance monthly or annually.
Prices may change with 30 days notice.
Cancellation takes effect at end of billing period — no pro-rated refunds except where required by law.
You are responsible for applicable taxes.
6.Intellectual Property
The Service and its content (excluding your content) is owned by Michell + Marteen LLC and protected by intellectual property laws. No trademark or branding rights granted.
7.Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
8.Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MICHELL + MARTEEN LLC SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF $100 OR AMOUNTS PAID IN THE PRIOR 12 MONTHS.
9.Indemnification
You agree to indemnify Michell + Marteen LLC from claims arising from your use of the Service, your content, or your violation of these Terms.
10.Termination
We may suspend or terminate accounts for violations or with reasonable notice. You may terminate via Settings. Sections 4, 6, 7, 8, 9, 11, and 12 survive termination.
11.Governing Law and Disputes
Governed by Texas law. Disputes resolved by binding arbitration in Harris County, Texas under AAA Commercial Arbitration Rules. Class action waiver applies. Either party may seek injunctive relief in any competent court.
